The NMRIRB Website may contain bulletin board services, chat areas, news groups, forums, communities, and/or other message or communication facilities designed to enable you to communicate with the public at large, communicate or provide information to the NMRIRB in connection with projects related to the Nunavik Marine Region or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages, material and information (collectively, “Submissions”) that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

(a) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

(b) publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful          topic, name, material or information;

(c) upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents;

(d) post or transmit any material or information that is (i) derogatory or harmful to our reputation or any of our respective officers, members, employees, representatives, licensors, service providers, suppliers, visitors or users in any way; (ii) harmful to children in any manner, or (iii) for the benefit of any third party;

(e) upload files that contain viruses, corrupted files, harmful component or any other similar software or programs that may damage the operation of another’s computer;

(f) interrupt, or attempt to interrupt, the operation of the Website in any way or use the Website to distribute viruses or malware or other similar harmful software code;

(g) advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages;

(h) conduct or forward surveys, contests, pyramid schemes or chain letters;

(i) download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner;

(j) falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;

(k) restrict or inhibit any other user from using and enjoying the Communication Services;

(l) violate any code of conduct or other guidelines which may be applicable for any particular Communication Service;

(m) harvest or otherwise collect information about others, including e-mail addresses, without their consent.

Except as required under applicable law, the NMRIRB no obligation to monitor the Communication Services. However, NMRIRB reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. NMRIRB reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Please note that if you are providing information, a document or a Submission to the NMRIRB through this Website that relates to one of the NMRIRB’s public duties or responsibilities under the Nunavik Inuit Land Claims Agreement and applicable territorial and federal law, then you must understand that you have no expectation or right of privacy concerning that information or document. We are not under any obligation to keep confidential any Submission or other information you supply to us, unless we have separately agreed to do so in writing or are required to do so under applicable law. By posting or uploading Submissions to this Website, you grant NMRIRB a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, fully transferable, assignable and sub-licensable (through multiple tiers), worldwide right and licence to use, reproduce, store, adapt, translate, modify, make, have made or make derivative works from, transmit, distribute, publish, sell, offer for sale, import, publicly perform or display such Submissions for any purpose that NMRIRB may choose in its sole discretion and through any means or media, whether now existing or subsequently developed, and without any compensation to you or any third party. In addition, you hereby (i) agree to waive all moral rights in any Submission in favour of NMRIRB; (ii) consent to your name, address and e-mail appearing as the contributor of any Submission, where applicable, and to the disclosure and/or display of such information and any other information which appears in or is associated with a Submission; (iii) acknowledge and agree that NMRIRB is not responsible for any loss, damage, or corruption that may occur to your Submissions; and (iv) acknowledge and agree that any Submissions you provide for display on this Website will be considered non-confidential. You will cooperate as fully as reasonably requested in the defense of any such actions; however, we reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

NMRIRB may (or may be required under applicable law to) provide or make available data, information or some or all Submissions through a public registry available on the Website and which may be accessed or accessible to users without the need for registration of an account on the Website. Submissions may be available and viewed by the general public.

NMRIRB may review Submissions before they are posted and may refuse to post any Submission to this Website. NMRIRB reserves the right, in its sole discretion, to edit or remove any Submission. You acknowledge and agree that NMRIRB may, in its sole discretion, monitor this Website periodically and disclose any information as necessary to satisfy any law, regulation or other governmental or Court request, to operate this Website properly or to protect itself or other users of the Website. Any such disclosure shall be in accordance with NMRIRB’s Privacy Policy.

NMRIRB is not responsible for the content of any Submission and the views, opinions and comments contained in any Submission are of the person(s) posting the Submission and do not represent the views or opinions of NMRIRB, its directors, officers or employees.
